My name is Duncan Henderson.

I am an Inverness criminal lawyer with over 30 years experience undertaking criminal defence work, road traffic cases and criminal legal aid. I offer a full criminal defence service from the police station to court. Clients who instruct me have the advantage of being represented by the same solicitor throughout their court case. This allows a truly personal relationship with clients. My office manager is Mrs Sarah Henderson,BSc, an accredited criminal paralegal and law accountant with the Law Society of Scotland. Experience shows that many clients have found this website a useful way of making contact with me and having their cases successfully defended in Court. Full contact details are under the "Contact Me" tab.

I undertake all aspects of criminal law including road traffic, sex offences, computers, dogs, dishonesty, assault, drugs etc. The work covers everything from initial police interview, up to High Court cases. When required I also undertake criminal appeals. I ALWAYS ADVISE SPEAKING TO A LAWYER BEFORE A POLICE INTERVIEW (which is now automatically covered by legal aid in Scotland).

I appear mainly in Inverness Sheriff and Justice of the Peace Courts. There are likely to be changes in the local courts on completion of the Justice Centre in Inverness in March 2020. This covers Inverness, Ardeseir,Croy, Cawdor, Nairn, Strathspey, Grantown-on-Spey, Cromdale, Nethybridge, Boat of Garten, Aviemore, Kincraig, Kingussie, Newtonmore, Dalwhinnie, Laggan, Drumnadrochit, Cannich, Fort Augustus, Invermoriston, Kyle of Lochalsh, Plockton, Lochcarron, Torridon, Achnasheen, Kinlochewe, Gairloch, Poolewe, Ullapool, Achnasheen, Contin, Garve, Muir of Ord, Dingwall, Strathpeffer, Beauly, Evanton, Culbokie, Munlochy, Avoch, Fortrose, Rosemarkie and Cromarty. Inverness Court covers the A9, A82, A86, A87, A95, A96, A831, A832, A833 A835, A889, A890, A896 and A939 roads. This is a huge geographic area. I have had to concentrate on the Inverness Courts due to pressure of business. I also cover police station interviews which are normally at Inverness.

I also undertake criminal appeal work when required. This has included a 5 bench decision. Another successful reported case on 10th February 15 under reference [2015] HCJAC 8 and can be read on the Scottish Courts website.

Perhaps the best recommendations come from my clients. The following have kindly been sent to me by clients after their cases were concluded. I am grateful for the time they have taken to send in their thoughts.

In April 19 a relieved client wrote to me on learning he would not be prosecuted and said "many many thanks for your reassuring words not only 2 weeks ago but back early 2018 when I was at my lowest. Although I did not need representation you kept me sane and I will always be grateful you took the time to talk to me. Your clients are lucky to have you by their side".

After a difficult road traffic case in November 18 a client kindly wrote to me to say "The court...was a bit nerve racking but didn't last too long after the Sheriff listened to your plea in mitigation. Thank you so much for that and for all the work you have put into preparing my case and acting for me. I am very grateful indeed. The outcome was better than I expected."

In October 18 after his not guilty plea had been accepted a client emailed to say "I honestly can't thank you enough for everything you've done for me, I knew I picked the right lawyer"

Following his acquittal at trial in July 18 a client emailed to say "I will recommend you to anyone needing legal assistance in the future! Thanks again for all efforts and I'm glad we got a good verdict yesterday!"

In June 16 a well known firm of Glasgow defence solicitors wrote to me to say "Thank you very much for agreeing to cover this case, a fantastic result and we will have absolutely no hesitation in instructing you again in the future and recommending you to others"

In October 15 after my client kept his licence for a case which started as a charge of dangerous driving he wrote "Thank you for all your help, you were fantastic and I really appreciate everything you done for me".

In March 15 following an acquittal in a jury trial a client wrote to say "Delighted with the outcome as I'm sure you can imagine. Couldn't have asked for a better service from yourself"

In November 14 following unanimous acquittal by a jury a client wrote to me "Thanks again for your representation in the early stages of this horrible ordeal. I so appreciate that you showed up at the police station at the very last minute on a Friday evening. You were a great comfort to me."

In July 14 a client sent me a card saying "just a wee note to thank you again for all the effort and help you gave me when I was faced with the unfortunate court [case]. I'm so thankful for you going above and beyond and taking the time to hear the background. Also for your input in the schedule of the day which allowed me to avoid the embarrassment of the press. You achieved the best possible result."

In June 13 after his case had been dropped my client wrote "Thank you so much for your help. Had you not been there to council me in the first place, I would be in a position that would have no doubt effected the rest of my life. You have been a great help and easy to communicate with through something I hope to never have to endure again. I cannot thank you enough for this"

In June 12 a client wrote to say "Thank you very much for your prompt and successful handling of these affairs, culminating overall in my most coveted outcome. I would definitely recommend your services or indeed use you again should the need arise. Thank you again very much for sorting it out, appreciate your work greatly!".

In February 11 a client wrote "many thanks for your assistance in court last Monday. I really appreciate you representing me and I am very happy with the outcome. I know its important to be able to speak the legal language as well as looking like I am taking the situation seriously. I think I would have looked foolish on my own. Probably not the most complicated case but it has made a difference to me".

Going back a bit further in time on 31st December 09 another client wrote "I wanted to take a moment to thank you for all your work on this case. It is clearly apparent that you have spent considerable time and attention working with me to gather the right information, collating this and subsequently presenting it in a way that is understandable and acceptable to the court. You have managed to reach what I consider to be a very positive outcome in relation to my charge, in fact it is fair to say that I believe you have managed to reach probably the best possible outcome there could have been. This whole process has been extremely unfamiliar to me and since my initial contact with you I have found you patient and extremely responsive to all my numerous questions and queries. Your calm manner and clear explanations have really helped me understand the process every step of the way, and helped me to remain calm through what has been a distressing and unnerving few months. I genuinely hope I never need legal representation again, however if I do ever have a need I would most definitely come to you first. I would positively recommend your services to anyone requiring legal representation, without any hesitation."

All solicitors are subject to the criminal quality assurance scheme. My most recent review of July 19 was described as “a very good pass”. During the review the files are assessed by other criminal solicitors and there comments on my work include “Excellent result for client”, “an outcome favourable to the client was achieved, largely thanks to the solicitor's efforts on his behalf”, “very extensive preparation undertaken with all potential issues identified and dealt with” , “case proceeded to trial after very careful preparation and client acquitted” and “the matter proceeded to trial and the accused was acquitted. He would have been delighted at the disposal. It was clear from the file that there was a high level of preparation for the trial and this clearly helped the acquittal”

I understand that Court can be difficult and stressful for clients. While I cannot guarantee the outcome of a case I would like to be able to guide you through the police and Court process and to assist you if you need an experienced criminal solicitor in the Highlands.
